  &lt;B&gt;If you are not legally divorced you would file as Married Filing Separate or Married Filing Joint.&lt;/B&gt;
&lt;/P&gt;&lt;P&gt;&lt;B&gt;Unless&lt;/B&gt; you have a qualifying child where you have paid over half of the household cost and have lived apart for the last 5 months, then you could file as Head of Household.&lt;/P&gt;&lt;P&gt;For more details on this exception see below:&lt;/P&gt;&lt;P&gt;
