    <description>&lt;P&gt;I've separated for a year now and we have 3 kids.&amp;nbsp; I want to claim one of them. I'm still (supporting them) by paying the mortgage, light bill, and internet bill. Mom pays the other bills.&amp;nbsp; Does that qualify me to claim on of them even though I haven't lived with them?&lt;/P&gt;</description>

      <description>&lt;P&gt;The IRS cares about physical custody.&amp;nbsp; &amp;nbsp;The parent with whom the child lived for the most nights---at least 183 nights-- is the one who can claim the child as a dependent on a tax return.&amp;nbsp; &amp;nbsp;If there is a signed agreement---on Form 8332-- then the non-custodial parent can get the child tax credit.&amp;nbsp; Do you have such an agreement?&lt;/P&gt;</description>
