My ex husband and I have two children and 50/50 custody. We typically each claim one child (I claim daughter, he claims son) as a dependent and each file as head of household. If my x husband is paying for an insurance plan through the Maryland Health Exchange for both children, does that mean I cannot claim my daughter as a dependent on my taxes? We never had a problem before and suddenly the Maryland Health Exchange people say you cannot claim anyone as a dependent if you do not also provide their health insurance plan. This is contrary to our custody agreement and never was an issue for four years. We would have to have separate pediatricians and specialists if suddenly one was on my insurance and the other on their father's because we have different plans.

I highly recommend you talk to a local tax pro and ask them about this matter. On the MD ACA site I cannot see why you cannot claim the child even if they are on the other parent's insurance ... it works in the other states but MD is different in many ways.
