      <description>&lt;P&gt;He can do that only if you can’t claim him or if both of you are eligible to claim him but he has a higher AGI than you, the parent, does.&amp;nbsp;&lt;/P&gt;</description>

&lt;P&gt;Generally, yes, that's how the tiebreaker rules work. When two people could claim a person as dependent, but only one of them is a parent, the parent always comes first. &amp;nbsp;If the parent decides not to claim the child, the other person can only claim them if their income is higher than the parent's income.&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;&amp;nbsp;&lt;/P&gt;
&lt;P&gt;For Adam to claim his sibling Bob as a dependent:&lt;/P&gt;
&lt;P&gt;1. Adam must be older than Bob.&lt;/P&gt;
&lt;P&gt;2. Adam and Bob must live together in the same household for more than half the year.&lt;/P&gt;
&lt;P&gt;3. Bob must be under age 19, or be a full time student under age 24.&lt;/P&gt;
&lt;P&gt;4. Bob must not provide more than half of his own support.&lt;/P&gt;
&lt;P&gt;5. No one claims Adam as a dependent. &amp;nbsp;(A person who is claimed as a dependent can't have their own dependents.)&lt;/P&gt;
&lt;P&gt;6. If Adam and Bob live together in the same household as their &lt;EM&gt;parent&lt;/EM&gt; (biological, foster, adoptive or step), then Adam can only claim Bob if:&lt;/P&gt;
&lt;P class="lia-indent-padding-left-30px"&gt;6a. The parents don't claim Bob.&lt;/P&gt;
&lt;P class="lia-indent-padding-left-30px"&gt;6b. Adam's AGI is higher than his parent's AGI.&lt;/P&gt;</description>
