Can I claim my daughter as a dependent? She graduated high school in May 2022. Turned19 in October 2022. Since then she has start working and will need to claim her own taxes, but can i still claim her? Will she still be able to file her own taxes?

Perhaps. A dependent must meet the requirements of a qualifying child or a qualifying relative in order for you to claim them on your tax return.

She will be able to file her own tax return. However, if you claim her as a dependent, she will not be able to claim herself on her own tax return.

The tests for a qualifying child are:

Relationship: Must be your child, adopted child, foster child, brother or sister, or a descendant of one of these (grand or nephew).

Residence: Must have the same residence for more than half the year.

Age: Must be under age 19 or under 24 and a full-time student for at least 5 months. They can be any age if they are totally and permanently disabled.

Support: The dependent must not have provided more than half of their own support during the year.

Joint Support: The child cannot file a joint return for the year.

The tests for a qualifying relative are:

Qualifying Child: They are not the “qualifying child” of another taxpayer or your “qualifying child.”

Gross Income: The dependent being claimed earns less than $4,400 in 2022.

Total Support: You provide more than half of the total support for the year.

Member of Household or Relationship: The person (a friend, girlfriend, non-blood relative) must live with you all year as a member of your household or be related to you.

TurboTax software will ask you simple questions and give you the tax deductions and credits for which you are eligible based upon your answers.

It mostly depends on whether she continued to live with you.

There are two types of dependents, "Qualifying Children"(QC) and Other ("Qualifying Relative" in IRS parlance even though they don't have to actually be related). There is no income limit for a QC but there is an age limit, student status, a relationship test and residence test.

A child of a taxpayer can still be a “Qualifying Child” (QC) dependent, regardless of his/her income, if:

He is under age 19, or under 24 if a full time student (high school counts) for at least 5 months of the year, or is totally & permanently disabled

He did not provide more than 1/2 his own support. Scholarships are excluded from the support calculation

He lived with the parent (including temporary absences such as away at school) for more than half the year

So, it doesn't matter how much he earned. What matters is how much he spent on support. Money he put into savings does not count as support he spent on himself.

The support value of the home, provided by the parent, is the fair market rental value of the home plus utilities & other expenses divided by the number of occupants.

The IRS has a worksheet that can be used to help with the support calculation. See: http://apps.irs.gov/app/vita/content/globalmedia/teacher/worksheet_for_determining_support_4012.pdf

Furthermore, there is a rule that says IF somebody else CAN claim him as a dependent, he is not allowed to claim himself. If he has sufficient income (usually more than $12,950), he can & should still file taxes. In TurboTax, he indicates that somebody else can claim him as a dependent, at the personal information section. TT will check that box on form 1040.

Good question and the advice given is spot on. I find that the Dependent Qualification Calculator at https://cotaxaide.org/tools/ is a great tool that simplifies wading through the list of IRS criteria for the various deductions and credits, if any, your daughter qualifies you for. Give it a try.
