topic Is Quick Employer Forms using IRS Combined Federal/State Filing Program (CFSF) for submitting 1099-NEC? in Get your taxes done using TurboTax

Could the FAQ for the TT Quick Employer Forms be updated to clearly specify whether the submission uses the IRS CFSF guidelines? For example, CA requires us to file the 1099-NEC but if we "file electronically with the IRS following the IRS Combined Federal/State Filing Program (CFSF) guidelines", then it's not necessary.

The FAQ in Quick Employer Forms only mentions to check the states requirement for filing. And this page provided by TurboTax doesn't mention CFSF either and it sounds like it doesn't include state filing ( "...doesn't support filing any state employer forms, nor does it support printed and mailed forms").

Can a TT employee please clarify?

Yes. Quick Employer Forms support e-filing to the SSA and IRS only. It doesn't support filing any state employer forms, nor does it support printed and mailed forms.

Hello. The critical part of the question was left unanswered. Is the Quick Employer Forms (TurboTax) submission of the 1099 NECs to the IRS done in a way to be considered CF/SF compliant? If so, the assumption is that the 1099 NECs would then be forwarded to the required State by the IRS. We understand that as it relates to this specific form, Quick Employer Forms (TurboTax) is not forwarding the forms to the State under any circumstance. For now the assumption we must make is that your submission to the IRS is NOT CF/SF compliant.

The answer is that each state has their own requirements, as indicated by @ChondelLO. That's 50 states compared to one IRS. The forms are filed with the IRS and then you must check your state requirement. Some states do not require you to submit forms to then directly, while other states require that you also file the forms with your state as well as the IRS (and Social Security for W-2s). You can use the link below to contact your state.

I agree the critical part of the question was not answered. It seems that this should not be difficult to answer by the administrator and we should not have to be left to make an assumption. Either Turbo Tax is or is not compliant and an approved provider with the IRS Combined Federal/State Electronic Filing Program (CFSF). Once this question is answered we will know the answer of what our state requirement is.

Based on the answer in https://ttlc.intuit.com/community/taxes/discussion/re-i-have-used-quick-employer-forms-to-generate-and-efile-a-1099nec-to-the-irs-do-i-need-to-fil/01/2831401/highlight/true#M1031536 the IRS automatically forwards specific forms to the states (if your state participates in the CF/SF program), regardless of what program you used to electronically submit the forms. The answer in that thread lists the forms that are submitted by the IRS to the states, which includes 1099-NEC. It would be good if TurboTax would explain that clearly in the FAQ of the Quick Employer Forms.

It was not answered and I agree we shouldn't have to assume one way or another. I already know my State requires the 1099s and is part of the CFSF program...so I will have to call the IRS to see if the Quick Employer Forms through TurboTax Business is compliant and will be forwarded to my State. Either that or a call to my State Tax Board.

The critical question is not whether QEF is compliant, but if your state participates. The CS/CF program is offered to states by the IRS. If your state participates, the IRS will forward your 1099 information to your state. If your state does not participate, you are responsible for filing your 1099s with your state. Once you have completed and e-filed your 1099s through QEF, you can print the state copy and submit using the summary sheet required by your specific state, found on your state's tax website.

Per the IRS:

These states do not participate in the CF/SF program:

IA, IL, KY, OR, PA*, RI, UT, VA, WV, VT, DC*.

All mandated forms will need to be filed direct to the state.

*PA and D.C. although listed in 2022 Publication 1220 as participating states but according to the IRS, forms for these states will not be accepted until next year.

These states although they participate in the CF/SF program but have certain specific to state requirements that filing via the CF/SF does not satisfy:

AL, AZ, CT, DE, GA, IN, KS, LA, MA, MI, MN, MS, MT, NC, ND, OH, SC, WI.

It is your responsibility to verify the filing requirements with the state as the requirements vary by state.

@dbode33 @rberger22
