Resident of IL, live in WI, received a letter from WI saying I owe on capital gains already taxed by IL

I filed my taxes at the end of Feb. IL is my State of Legal Residence, so I file my taxes with them. I also work some side jobs, so I make money in WI and have to file with them for that money made. This year I sold a bit of stocks and made some money off it. My understanding is the income made from those capital gains is taxed by my Residence state.

When I filed originally, WI was supposed to return $26. I got a letter yesterday saying I owed them about $600. I did some digging and based on the numbers their changing, it looks like they're trying to add my capital gains income to this. Is it normal for capital gains to be taxed by a non-resident state? It seems I'm getting double taxed on capital gains and I'm not really sure what to do about it.

Make sure you enter the 1099-R in the federal section and answer all follow - up questions there. Where do I enter a 1099-R? In the state return, you will see the details of the subtractions on the page titled Here's the income the Colorado handles differently.

If you were at least 55 years old at the end of the year, part or all of your income from your pension, annuity, Social Security or IRA accounts that is taxable on your federal tax return may not be taxed by Colorado.

For those 55 years and older, this subtraction applies to those who receive disability payments before minimum retirement age from a plan paid for by an employer. The disability payment must be taxable on your federal tax return and for permanent disability.

For people under age 55, this tax break also applies if you receive income as a beneficiary due to the death of the person who earned the pension.

Note: Premature distributions do not qualify for this subtraction. The railroad retirement benefits subtraction is allowed on the Subtractions from Income Schedule (Form DR 0104AD) automatically and not here.

If I put 0 as reportable wages to MI, then the wages appear on the NR Schedule 1, line 5 under « Other State Income », but they should be listed as a Subtraction on the regular Schedule 1, Line 14 as military pay. So I don't feel putting them on the NR schedule is the correct way. TurboTax is just not handling it correctly. When both are marked as full-year residents, then the wages get exempted on Schedule 1, Line 14 as they should.

I just reviewed your file. Open your Michigan tax return, and navigate to a screen called Michigan Wages. There you will see a federal amount and a Michigan amount. Put "0" for Michigan wages.

Here is a link from michigan.gov that verifies that active military pay is excluded from Michigan income. The only michigan income that should be taxable now is interest and dividends.

For TurboTax Online:

Thank you for the answer, everything you explained is exactly what I’m trying to do, but it doesn’t seem to be possible in the online version.

The military pay subtraction does appear on the Michigan return under "Income/Military Pay Adjustment" section, but ONLY when both spouses are marked as full-year residents. As soon as I change the non–active-duty spouse to part-year or nonresident, that subtraction option disappears from the income section, even when keeping the military member as full-year.

The Premium Online version doesn’t allow direct form editing, so it seems like I can’t use this version, which is frustrating, since it’s the free option for military members.

What is your state of legal residence (SLR)? It generally is your home of record unless you changed it to another state. Is Minnesota you state of legal residence? Please clarify.

From a tax standpoint, your state of legal residency (SLR) is considered your "domicile" or "resident" state as long as you are on active duty. Even if you are stationed in another state, you are still considered a resident of your state of legal residence.

To find out if you need to file a state tax return when you are not stationed in your resident state, check out Military Filing Information on State Websites, which has links for active duty military and their spouses in each state.

If you have nonmilitary earnings, review Civilian pay earned by active duty military.

In some cases, if you have nonmilitary earnings, the nonmilitary earnings may be subject to the state income tax of the state where you are stationed.

I keep getting asked to review a fix for my federal return. First there are two typos in it and it won't show the window for me to make any corrections. It states:

Person on the Retun Worksheet (my name): Enrollmentstatus must be entered.

As you can see, there is a typo in RETURN (missing second r) and ENROLLMENT STATUS (no space).

It also won't show the window to fix the error so I can't efile. This is extremely frustrating especially since we have to pay to file!

Re: How do I exempt military pay on a Michigan state return when spouses have different residency...

1. Check the "Member of the Household" Logic

In the Personal Info (or My Info) section, ensure the military member is still marked as a Full-Year Resident of Michigan.

Even if you are stationed elsewhere, for tax purposes, your "State of Legal Residence" remains Michigan.

If you marked the military spouse as a "part-year" resident because you moved on orders, TurboTax may stop looking for the Michigan military exemption.

Keep the military spouse as a Full-Year Resident of Michigan (unless you actually changed your State of Legal Residency via DD Form 2058).

2. Manual Entry in the "Subtractions" Section

If the "Deduction for Military Pay" screen disappears during the automated interview, you have to find the manual entry point in the Michigan state interview:

Go to the State Taxes tab and start/edit Michigan.

Look for a section titled "Subtractions from Income" or "Income and Adjustments."

Navigate to "Military Pay" or "Military Subtraction."

Even if the specific "Military Spouse" logic is acting up, you should see a line for "Active Duty Military Pay included in Federal AGI." 5. Enter your total active-duty pay here. This will flow to Michigan Schedule 1, Line 14, which is the official line for exempting that income.

@user17751385021

Yes, everything is entered correctly. If I mark both spouses as full year residents, the page "Deduction for Military Pay" comes up and confirms that the military pay was exempted. But if i change the non-military spouse to either part-year or non resident, this page never comes up and the military pay of the full-year resident remains as taxable income. Is TurboTax able to handle this situation?

Re: How do I enter 24 years of military service and 22 years of US Postal Service?

When entering your combined service history into Oregon PERS or a standard state application, it’s important to know how your two federal careers fit with Oregon’s requirements. Here is how to report your two 1099 R's and how to report your years of service in the Oregon return.

1. Enter the Income (Federal Section)

You should have one 1099 R for your military retirement and one for your USPS (FERS) retirement.

Go to Federal > Wages & Income.

Scroll to Retirement Plans and Social Security and select IRA, 401(k), Pension Plan Withdrawals (1099-R).

Enter your Military 1099-R and your USPS 1099-R separately.

Crucial Step: When entering the Military 1099-R, TurboTax will ask "What type of plan is this?" Be sure to select Military Retirement. This triggers the specific tax breaks for veterans.

2. Claim the Oregon Subtraction (State Section)

Oregon allows a Federal Pension Income Subtraction. Because you have a mix of pre-1991 and post-1991 service, TurboTax needs to calculate how much of your pension is tax-free in Oregon.

Go to the State Taxes tab and start the Oregon return.

Look for a screen titled "Here's the income that Oregon handles differently" or "Federal Pension Subtraction."

TurboTax will ask for your "Total Months of Federal Service" and "Months of Service before October 1, 1991."

Your 46-Year Calculation:

Add your military months and your USPS months together.

Only the months served before October 1, 1991, count toward the tax-free percentage.

If you have overlapping months (e.g., you were in the Reserves while at the Post Office), do not count those months twice.

As a FYI, if your 1099-R from DFAS or OPM has an empty Box 16 (State Distribution), TurboTax might get confused and think $0 is taxable. Manually enter the same amount from Box 1 into Box 16 and select OR as the state. This turns on the Oregon module so your military subtraction is applied correctly.

In TurboTax, in the Michigan state income tax return, if both spouses are reported as full-year residents of Michigan, active duty military pay is exempt to Michigan.

If one spouse is reported as part-year resident of Michigan, active duty military pay is exempt to Michigan.

Under Personal Info or My Info, make sure that you correctly report for the spouse that they lived in another state and the dates that they lived in each state.

3. Under Military select Military Benefits Subtraction and Start or Revisit

4. Enter total qualifying military benefits received

TurboTax automatically exempts military pay it when both spouses are marked as full-year residents, but if I change the military spouse to part-year or non-resident, the exemption is no longer applied. I’ve tried everything—what am I missing?
