Yes, they are considered taxable income to the former spouse. DFAS is required to issue the former spouse a Form 1099-R each year reporting the former spouse’s portion of retired pay. But if you are the only one receiving a 1099-R with the total amount taxable to you then you should be able to deduct this as alimony and she will have to report it as alimony income.
