How does y our ex get paid? If the pension pays her part to her then she should get her own 1099R for it. If you get the full amount and pay her then it is taxable to you. What you pay your ex is a separate item and may or may not be deductible as Alimony. If you can set up your pension payments so her part goes directly to her from the company then she would get her own 1099R and you would only be paying tax on just your part.
The US Govt, OPM pays her direct under a court ordered apportionment. My 1099 shows the gross amount in block 1, block 2A shows taxable amount not determined. Then at the bottom of the 1099 in bold print is statement GROSS ANNUITY REDUCTED BY $XXXXXX PAID TO NAME XXXXX UNDER COURT ORDERED APPORTIONMENT. TAXIBLE AMOUNT NOT DETERMINED. SHE GETS A 1099 FROM OPM.
Then your 1099R should be only for the amounts you got. It should not include her payments, she gets her own 1099R. Yours is separate.
That is NOT what the US GOVT does for pensions. I wish it was that easy.
They use the Taxable amount not determined box, note what they apportioned to the former spouse in the notes section and leave it to us to figure this out.
This is a very common situation to have pensions split with a former spouse and I am NOT the only person who has this situation. There has to be some easy way to do this in Turbotax.
Does she get the same gross as you? Sorry the 1099R and boxes 1 and 2a should be only your part.
No-she gets a separate 1099 from the GOV with her apportionment and files that separate.
My gross is the entire pension. Then in notes is the statement I provided to you.
My Box 2A Taxable Amount says UNKNOWN
