The best way to determine this would be to add the kids to your return and then to his return and see who ends up with the largest refund.  You then need to delete them from the one who is NOT claiming them. 

You may be eligible for the Earned Income Tax Credit based on income alone, he is not.  But, you may not be eligible for the full amount of the Additional Child Tax Credit since your income is $10,000
