If I receive a 1099-R distribution from a pension from my deceased spouse (code 4) annually, can I exclude it from income as a death benefit?

Since I receive this amount annually, it may be a RMD--if so, does this affect the amount of tax I pay on it?

No, you can not. It is fully reportable and taxable.If it is truly a pension, then there is no RMD. If you rolled it over to an IRA, then there is an annual RMD.
