If I pay the down payment on my sons house is it considered a gift and taxed over $15K?

your down payment would have to be in the multi million dollar range before you would owe a gift tax.  but you do have to file a gift tax return if the down payment is over $15,000.     However, if he's obligated to pay you back.  then there is no gift.
