If you are past the age for taking an RMD, and failed to do so, the penalty for 2023 is 25% of the amount of the missed RMD.
However, what you should do is request a withdrawal now (as soon as you can). When you file your tax return, you include form 5329 for the missed RMD penalty, but request a waiver of the penalty. (Part of the request for the waiver is that you took the withdrawal as soon as you realized the mistake in January.) These waivers are almost always granted.
Then, when it is getting close to the end of 2024, you will still need to take your RMD for 2024, since you are using the January 2024 withdrawal to count as your 2023 RMD. Make sure to set up the withdrawal a few days early, because it usually takes a few days for the broker to process the request, especially during the end of year rush and holidays.
Lastly, remember that an RMD is not a special transaction, it is the minimum amount you need to withdraw during the year. Suppose your RMD is $5000. That could be satisfied by a single withdrawal of $5000 on December 29, but it would also be satisfied if you had been withdrawing $500 per month all year for living expenses (since the total exceeds the minimum requirement).
If you had an agreement with the broker to make a withdrawal and the broker failed, I don't know if it is possible or practical to complain to the broker and have them pay the penalty for you. Your goal should be to request a waiver and not pay a penalty in the first place.

Are you sure that's true? The penalty for failure to take an RMD on an inherited IRA is waived, because those rules have not be finalized. I was not aware that all RMD penalties are suspended.
I just ended an online update class today and that is what was said ... also the tidbit that although the IRS accepts the 5329 form with any penalties that folks want to send them they have never sent a letter imposing a penalty for failure to make the withdrawals timely. In the 30+ years doing taxes I have never filled in a 5329 for any client and to date there have been zero IRS notices. They just don't have the ability to match up all of those RMD to the returns.

Only if this was your first RMD, you would have a grace period to April 1 of the following year. See HERE under Q3.
In your case, you would be subject to a 25% penalty unless you can prove that the reason that the reason the distribution
was not taken was due to a reasonable error. You must file form 5329 and attach a letter of explanation. See HERE under Q9

You need to include the penalty form and ask for a waiver. They are almost always granted. Then remember, that since you are using this withdrawal (1/10/24) to count as your 2023 RMD, you still need to take a 2024 RMD before the end of the year.

You don't actually generate the form on your own. There are RMD questions following your 1099R entry. How you answer these questions will determine the need to report a 5329. One question that comes to mind is a question that asks you if you took an RMD distribution and if you say no, this will automatically generate an RMD.
It's a form where you don't find it, it will find you under a diverse set of circumstances.
