Does anyone know if with the treasury offset program, do they only take the past years state taxes example the amount owed for 2020 only? Or will they take 2021 too?

Last year, they offset my taxes for 2019's state tax owed, but I wasn't sure if they would take the current year as well. Since 2021 isn't actually considered "delinquent"

They will only do the offset for delinquent tax years.  So, if you still owe more for 2019, they may take it.  They will not take your federal refund for 2021 taxes that are not yet delinquent.

If you still owe any back taxes or child support then your 2021 refund can be seized to pay the debt, even if you have a payment plan in place.   The IRS will offset any refunds you are getting until the debt has been fully paid.   The IRS is not going to know yet if you have state tax due for 2021.
