Do i have to pay taxes on my nys pension in PA. I'm 57 years old?

UPDATED FOR TAX YEAR 2019

 

No - as long as you are eligible to retire and have retired.

 

Instructions for the PA 40 return include in their list of Income not taxable for PA PIT purposes:  "Commonly recognized pension, old age, or retirement benefits paid after becoming eligible to retire, and retiring"

 

If you are either not eligible to retire or haven't retired yet, the pension is taxable.

As you go through the interview for the PA return, you will come to a screen, What kind of retirement income do you have from Pennsylvania?   Depending on your situation you need to choose either:
  • I'm eligible; plan's eligible (no PA tax); or
  • I'm not eligible yet; plan's eligible in PA.
