Yes, if the IRA is your name and you are aged over 59 1/2, there is no early withdrawal penalty. Your husband's age does not matter.

Yes, if the IRA is your name and you are aged over 59 1/2, there is no early withdrawal penalty. Your husband's age does not matter.

will i have to file separate or can i still file married, will tt form know that it is my IRA?

You can file jointly. When entering your form 1099-R, you can specify to which spouse it belongs to.
