Based on my retirement being separate property and my husband only receives SSDI, do still complete the form 8958.

My husband has been on SocIal Security Disability since before we got married, he pays zero taxes.  I retired before we got married. We have no community property income. Do I still complete the form 8958?

If you are filing separate and resident of a community property state, a Form 8958 must still be filed.  The allocation will simply assign the income as separate property,
