My RSU's were converted during a merger which has produced a 1099-B but I have not sold anything. Does the IRS consider this a sales in this scenario?

Yes.  A 1099-B very definitely indicates a sale has taken place.  You really have sold something, even though the stock you currently own has a name virtually the same as the stock you used to own.
