If my rental income is less than depreciation and my income is more than $100,000, will i over pay tax on depreciation recapture? how to fix it ?

no, the max is 25% but you'll pay less if you are in a lower tax bracket.

what i meant is,  suppose i get 10,000 in rental income and 20,000 in deprecation.  I will ended up paying tax for 20,000, not 10,000, which seems unfair.
