I'm in prison in PA with no income. I own a residential rental property in MN. My mailing address is my parents' address in MN. Do I choose MN or PA for my residence?

You will be considered a resident of Minnesota. Therefore, you should file a Minnesota resident return only. According to the Minnesota Department of Revenue, a resident who is away for a temporary absence is still considered a Minnesota resident. You do not have a filing obligation to Pennsylvania since you do not qualify as a resident and you have no Pennsylvania source income. According to the Pennsylvania Department of Revenue, if a person moves to the state, but only intends to stay there for a fixed or limited time (no matter how long), his.her domicile does not change. The domicile is not dependent upon continuous physical presence.
