Hi, I recently moved my VACANT rental property under my son's name, however I pay all expenses for upkeep. Can I claim this on schedule E?

Hi, I recently moved my VACANT rental property under my son's name, however I pay all expenses for upkeep. Can I claim this on schedule E?

If the property was vacant but still held out as available for rent, you would be able to claim expenses you incurred, prior to the date the deed was transferred, on Schedule E. 

If the property was not available for rent during the year, you would not be able to deduct the upkeep expenses.  Any Capital Improvements to the property during the time it was not available for rent would increase the basis of the property.  

After the deed transferred to your son, your ownership in the property ceased and any expenses you paid related to the property are not deductible to you.

That’s correct, I don’t hold the deed but still pay all expenses for upkeep -and my son will not be claiming any activity as their is no rental income and I’ve paid expenses
