Do i have to apply the max deduction for capital loss carryover even though my gains are under $3000

losses are netted against gains then if net losses exceed $3000, $3000 is taken no choice.   however, if you have a net operating loss while it appears $3000 has been used in fact nothing may have been used and the full 2019 capial loss would carry over to 2020.
