Work in Missouri, live in Kansas, work in office and remotely. How do I file?

I never know if I should consider the tax rate of each state and choose one over the other?

Since Missouri and Kansas do not have a tax reciprocity agreement, and Missouri does not follow the "Convenience of the Employer" rule for remote workers, your taxes are based strictly on where you physically performed the work.

Here is how you file, assuming you are a resident of Kansas all year:

  • First, file the Missouri Non-Resident Return; and allocate to Missouri the amount of wages you earned while working physically in Missouri. Missouri will only tax you on that specific portion of income.
  • Second, file the Kansas Resident Return. Report 100% of your wages to Kansas. You then get to claim a credit for taxes paid to another state. This prevents you from being double-taxed on the income Missouri already taxed.

Note: if you are using TurboTax, you must prepare the Missouri non-resident return first. Once the Missouri return is complete, the software will automatically carry that information over to your Kansas return to calculate your tax credit correctly.
