My step-son is in prison and we pay him a certain amount every month. He's been in for 5 years so far. I have never had him as a dependent. can he be a dependent?

No. To claim a dependent, you must pay more than half of the dependents support. The state/county is paying for his housing, food, clothing, medical, etc. You will likely not be able to show that you pay more than half of his support, so you can not claim him as a dependent.
