Marketplace Form 8962. How to allocate when one person is not eligible for tax credits.
I got insurance for myself and my 25-year-old son. Because of some income late in the year, I'm not eligible for tax credits and will have to pay back all of it. My son is not a dependent and is filing his own return, but he had low income and is eligible for the maximum subsidy. He and I are trying to figure out how to allocate our subsidies.
This is the first year he was issued a separate 1095-A, even though he was on my policy. That is what is confusing me. In the past he was listed as covered under mine, but he turned 26 in September. His 1095-A shows information for every month of the year, not just after he turned 26.
The instructions I've seen online when sharing a policy with another taxpayer says to divide the allocation so that it adds up to 100%. I'm trying to figure out if that's correct for our situation.
1) I figure since I became not eligible and he is, we should allocate 0% to me and 100% to him. Does that make sense? Or do we each allocate 100% of our individual 1095-As?
2) How much do we put in for lines 21-33 of the 1095-A? Do we add our two 1095-As together? Or does each of us put our own 1095-A info only? If I put just my 1095-A numbers (monthly premiums ≈$14000, SLCSP ≈$15000, monthly tax credits ≈$14000) and set my allocation to 0%, then my taxes go down. His form's numbers are much lower for premiums and tax credits: monthly premiums total≈Ω$5000, monthly tax credits ≈$1000. We had the same plan, so his SLCSP is also ≈$15000. I was wondering if we were supposed to add the numbers together. In other words, we would both enter monthly premiums ≈$19000, SLCSP ≈$30000, monthly tax credits ≈$15000.
3) I'm trying to make sure I'm not underpaying. The instructions I've read said that when people share a policy, you can allocate the credits however you want so long as it adds up to 100%. If I make it 100% him and 0% me, it says he's going to be refunded more money than I ever paid in, and I have to repay much less. I just want to make sure I'm not underpaying. It looks like I have to set us both 100%, but that goes against the instructions.
