Are you trying to ask if you are married by common law and if you can file a joint tax return?   There are only a few states that recognize common law marriage.  Are you in one of those states?  If so, do you meet the state's criteria to be considered married by common law?   The state laws vary.  You can google the laws for your state.

 

STATES THAT RECOGNIZE COMMON LAW MARRIAGE

CO, DC, CO, IA, KS, MT, OK, RI, SC, TX, UT

 

 

If you are not in a common law state then you cannot file a joint tax return.

 

 

And what did it have to do with his van?

Please clarify your question.  Do you have a common-law marriage, and are you trying to file a joint return?
