Question

I was in US from Jan 1 2025 to April 17 2025. Am I considered a nonresident alien spouse or dual-status alien spouse? I'm a US citizen acquired through naturalization.

I am assuming you became a naturalized citizen prior to 2025.

 

If you are a US Citizen for the entire year (including by naturalization), then you are not a dual status alien or non-resident alien even if you left the country for a couple of months.

 

 A non-resident alien would be a person who is not a US Citizen who does not meet the green card test or the substantial presence test. 

 

 A dual status alien would be a person who was a non resident alien and then became a resident during the year because they met the Green Card test or substantial presence test for only part of the year. 

 

As a US Citizen you have a filing requirement to file all income from all sources even if you are outside of the country.  You would file form 1040. 

 

If you did not become a naturalized citizen until part way through 2025, please respond with where you lived prior (country), and how long you were in the US, if you had a Visa and if so which type or if you had a green card.
