Question

I was an F1 student from August 2013 to August 2017 after which I was on OPT status till December 2018. Do I file tax as a non-resident or a resident?

  • F1 student from August 2013 to August 2017
  • OPT from August 2017
  • Changed to O-1 visa on December 2018

Am I considered exempt due to F1/OPT status or do I file as a resident? Sprintax says I am a resident for tax purposes, but I wanted to make sure that is the case.

You were exempt 2013,2014, 2015, 2016, 2017.  You start counting days of presence starting January 1, 2018.  You are a resident as of January 1, 2018 (the first day you was present in United States during the calendar year in which you passed the substantial presence test).

You need to file a full year resident US tax return. You can file with TurboTax!
