Question

I did not receive the first stimulus in 2019 because I was recently widowed and the IRS was still counting my husband's income How can I claim it now?

My husband passed in early 2019   I did not receive the first stimulus payment that was issued that year because they assumed my husband's income would put me over the limit.  I filed as surviving spouse and only had 9 weeks of his income that year

Very sorry for your loss.

 

The first stimulus was really a credit based on your 2020 income.  Congress wanted the checks to go out in a hurry so they based the payments on either 2019 or 2020 tax returns.   If you did not get the 1st and/or 2nd stimulus check the way to get it is to file a 2020 tax return and use the recovery rebate credit to get it.   Did you file a 2020 return?   If you did, look on line 30 and see if the credit is there.   If it is not there then amend your 2020 return and use the recovery rebate credit in Federal Review to get the stimulus payments.  The 1st one was $1200 and the 2nd one was for $600.

 

The way to get the 3rd EIP payment is to file a 2021 return and use the recovery rebate credit in Federal Review to get the $1400 3rd EIP payment.

If you were entitled to the either of the first two stimulus payments based on your 2020 income, but did not receive them because you didn't qualify based on your 2019 income, you can get them in the form of the Recovery Rebate Credit by filing a 2020 tax return.
