Question

How to reclaim a Withholding Tax

I am a US Citizen and my husband is Canadian.  We listed our California home on VRBO and accidently filled out a W-8BEN.  There was a large amount of tax withholding because of this.

How can I reclaim this tax amount on my Income Tax report to the IRS?

Thanks

W-8BEN is reported to the withholding entity, so in your case I would assume VRBO.

If it was filled out incorrectly, I suggest you contact VRBO and file a new W-8BEN or W-9 if you are a U.S. Citizen.

You'll have to file a tax return in order to get excess tax withheld refunded.

If the tax is not reported on a 1099, enter it under Personal "Estimates and Other Taxes Paid" "Withholding not already entered on a W-2 or 1099.

Be sure you don't also enter the tax as an expense on your Schedule E or Schedule C for the rental income.
