How do I get my penalty waived for not having insurance-due to having hardship?

It depends.  To apply for penalty exemptions such as these, you must submit them to the marketplace, and the marketplace must grant you a certificate of exemption before you can file.  Please see the following website for more information as what are exemptions they will consider:  https://www.healthcare.gov/health-coverage-exemptions/hardship-exemptions/
