How do I file my tax returns without it being rejected due to missing 1095-A information? The 1095-A the IRS has associated with my SSN is in accurate and fraudulent.

Unfortunately, there's no way.to e-file in this situation. You should go to the marketplace website and get a void 1095-A or a letter saying you did not have marketplace coverage. You'll have to mail in your return.

This is a serious failure of Turbotax. Other tax software seem to offer the ability to attach your voided 1095-A and write in a description of the issue for "ACA Explanation" - in fact, this is the exact guidance from IRS: https://www.irs.gov/newsroom/how-to-correct-an-electronic[product key removed]n-rejected-for-a-missing-form-8962

 

"Q6. What if I think I am not required to file Form 8962? (updated Nov. 8, 2024)

A6. If you think you are not required to complete Form 8962 and include it with your return, you should contact your Marketplace to confirm that APTC was not paid to your health insurance company for you or any member of your family. After confirming that APTC was not paid for you or any member of your family, you should include with your return a PDF attachment titled "ACA Explanation" with a written explanation of the reason why you believe Form 8962 should not be required. You may also upload any copies of a corrected or voided Form 1095-A from the Marketplace or any notice issued by the Marketplace indicating proof of no enrollment. You should follow the instructions provided by your software company on how to include a PDF attachment with your return."

 

One of the primary reasons to buy turbotax is to efile, which is by far more secure.  ACA fraud is pretty common place now and if we are required to mail our returns after buying the turbotax software, then our secure transfer of our return is compromised even moreso.
