Do I file as a dual-status or resident for the entire year after leaving the US in August?

I have been staying in the US since 2008, and on H-1B status since 2014. We moved to Canada in August and now getting Canadian income. Is it okay to file taxes as a resident and report Canadian income for the remaining of the year 2024 and claim credits since US has a treaty with Canada?

    Yes, you can file as a US resident in 2024 and report your Canadian income. If you pay tax to Canada on that income, you would need to claim a foreign tax credit paid to Canada.  This is the menu path for claiming.

     

    1. Go to Federal
    2. Deductions and credits 
    3. Estimate and other taxes paid 
    4. Foreign Tax Credit>start or revisit

    You also have the option of filing as a dual-status citizen whereas you could exclude your Canadian income for US tax reporting purposes. If you decide to make this election, you would need to file with Sprint Tax because your 1040 NR would be your main form for filing. Please read the link provided below for more information.
