Determine state residency and tax requirements

I retired from active duty military on 01 October 2021.  My residency was Florida (no state tax), but I now reside in Virginia.  Am I required to pay state tax on my military retired pay for (October - December 2021) and going forward.  And how do I change me residency?

    Now that you are retired, you are a resident where you live. So you are a part year resident of Virginia for 2021, and will have to pay Virginia taxes on your military retirement pay.

     

    The only way to change your residency after retirement, is to establish residency in a different state.

     

    These are some of the factors that determine your state residency:

    • Your mailing address.
    • Your driver's license and  auto registration.
    • Your voter's registration.
    • Where you own or lease a property.

    It is worth noting that Virginia has been petitioned by several organizations to change this rule and it may happen in the future.
