Question

Daughter tagged in TT to file form 8615 for 1098INT earned, but does not satisfy part 3 of Who Must File; Earned Income WAS > 50% of support thus form NOT needed, yes?)

In instructions for form 8615, How Must File has several AND conditions, and to out understanding she does NOT qualify for the Form based on failing the conditions for #3 as while a FT student (for part of the year) under 24 she DID have an earned income which exceeded 50% of the support provided to her (she graduated and got a job so our part of support to her ended in June). It seems if she fails condition 3 she fails for the requirements of who must use form. So now what? It seems logical that she would just claim the 1098INT just like any other tax filer, but TT keeps sticking the form back in and asking for parent info even after we delete it. Are we thinking of the conditions for Who Must File incorrectly? What's the right path to move forward?

    from 8615 instructions

Was a full-time student at least age 19 and under age 24 at
the end of 2024 and didn’t have earned income that was
more than half of the child's support

    what's included in support

support includes all amounts spent to provide the
child with food, lodging, clothing, education, medical and dental
care, recreation, transportation, and similar necessities. To figure
your child’s support, count support provided by you, your child, and others.

    '''''''''''

so you are correct if her earned income exceeded 50% of her support'

are you claiming her as a dependent and did so indicate on her return?

you can not claim her as a dependent if she provided over 50% of her own support.

She did mark she was a FT student.

She did mark that she supported herself.

    We do not claim her

Form still insists on coming back.

We can look at the return and see exactly what you see to help come to a resolution. The return will be scrubbed and won't include any of your personal details.

Once you're logged in to your account,

    - on the left hand panel, click on Tax Tools and then choose Tools

    - on the pop up window, select Share my file with Agent

    - you'll see a message saying you'll give us a copy of your tax return. Your personal information will be changed so we can't see any private information.

    - click okay and you'll get another message with a token

Reply to this message with your token and we'll take a look to see what we can find. Please let us know what states are included in your return, if any.

    Q. What's the right path to move forward?

    A. Go through the personal information interview again.

When TurboTax sees that she is a fulltime student, under age 24, it will generate the earned income support question. Be sure to answer yes.  That should eliminate form 8615.
