Question

Can I still claim my adult disabled daughter if she received COVID 19 unemployment? Or does she need to file her own taxes? She also receives SSI.

She also did not have taxes taken out. We live in a state that you don't have to have state taken out.

First of all we do not know if you mean she received Social Security or actual "SSI" since people mix those terms up all the time and they are not the same thing---so what does she get?  Will she get a SSA1099--if so, she is getting Social Security.

 

If she had over $4300 of income in 2020  ---NOT counting Social Security -- you cannot claim her--and you do have to count the unemployment.

You might need to get your 1099G from the state’s unemployment site when it becomes available in January.

She receives SSI. I have always claimed her years before but last year she received unemployment under COVID-19. She did not have any taxes taken out. She lives with us 365 days a year.

If she received unemployment that suggests she was employed for awhile and received wages for that job.  Add up what she got from her job and the unemployment, AND the SSI.  If it is more than $4300 you cannot claim her.  She can file her own tax return AND she will be eligible for the stimulus money.  If you claim her she does not get stimulus money because dependents are not eligible.

If she is age 19 or older and not a full time student under the age of 24 and she has gross income of $4,300 or more then you cannot claim her as your dependent (unemployment compensation is included in gross income).

 

To be a Qualifying Relative -

1. The person cannot be your qualifying child or the qualifying child of any other taxpayer. A child is not the qualifying child of any other taxpayer if the child's parent (or any other person for whom the child is defined as a qualifying child) is not required to file an income tax return or files an income tax return only to get a refund on income tax withheld.
2. The person either (a) must be related to you or (b) must live with you all year as a member of your household.
3. The person's gross income for the year must be less than $4,300 (social security does not count) in 2020
4. You must provide more than half of the person's total support for the year.
5. The person must be a U.S. citizen or a U.S., Canada, or Mexico resident for some part of the year.
6. The person must not file a joint return with their spouse.
