How can I keep my tax return if my husband owes back child support?

You have 2 options

1) You can file as Married Filing Separate.  This for some people is the simplest option, although it does eliminate some credits and deductions such as Earned Income Credit and Student Loan Interest Deduction.

2) You can file a Form 8379, Injured Spouse Allocation with your joint tax return.  This can be added to your return in TurboTax by doing the following:

  • Click on Federal
  • Other Tax Situations
  • Scroll down to Other Tax Forms
  • Click Start Next to Miscellaneous Tax Forms
  • Click Start next to Report and injured or innocent spouse claim
