Has anyone figured out how to file 1099-misc for tribal percapita? its not income from work nor income from tribal gaming. Please help

Here's how to enter a 1099-MISC for tribal per capita payments in TurboTax. By following these steps the income will appear on Form 1040 line 21 with the description "Indian Tribal Distrib." It's very important that it be reported with this exact description in order to avoid delaying the processing of your tax return and possibly getting a notice from the IRS. The IRS computers recognize this description and will handle the income properly.

  • Click the Federal Taxes tab.
  • Click Wages & Income.
  • Click "I'll choose what I work on" or "Jump to a full list."
  • On the screen "Your 2016 Income Summary," scroll down to the section "1099-MISC and Other Common Income." Click the Start button for "Income from Form 1099-MISC."
  • On the screen that says "Did you get a 1099-MISC?" click Yes.
  • On the next screen, enter the information from the Form 1099-MISC that you received. The amount of the payment should be in box 3. After you enter the 1099-MISC information, click Continue.
  • The next screen asks you to enter a description of the reason for the 1099-MISC. It doesn't matter what you enter. I suggest "Tribal per capita distribution."
  • The next screen asks "Does one of these uncommon situations apply?" Select "This was a tribal member gaming payment" and click Continue. I know you said it's not from gaming, but select this option. It will not show up as tribal gaming on your tax return.
  • The next screen asks whether you have another 1099-MISC. If you don't, select No and click Continue.
  • This takes you to the 1099-MISC Summary. If you have no other 1099-MISC forms to add, click Done.

I am doing this very thing.  I followed your instructions because I was having issues getting rerouted to the same section over and over.  I get to the very last part of your instructions without any issues, however the very last step does not take me to the 1099-misc summary.  It keeps taking me to a screen that says choose the source of the income: 1) consulting, freelancing, contracting, your business 2) Farming 3) Income that should be considered wages, etc.  If I select any one of these I have an issue at the end of the part where I select "done with income", where it says form not reported, then goes on to explain that this form is not reported on another form or schedule and it just keeps re-routing me through this over and over again.  Not sure what to do here.

@andreahiles701 - To get to the screen with the three choices for the source of the income, you had to have answered an earlier question differently from what my instructions say, or you may have the income in box 7 of the 1099-MISC instead of box 3.

Is your 1099-MISC for a tribal per capita distribution, tribal gaming proceeds, or other tribal distribution, or is it for something else?
Which box of the 1099-MISC is the income amount in?

If it's for a tribal distribution and the income is in box 3, delete the 1099-MISC that you entered and start over. Carefully follow the instructions to the letter. As soon as you get to a point where what you see does not exactly match what the instructions say, stop and post a description here of what you entered and what you see.

If the income is something other than a tribal distribution, or if the income is in any box of the 1099-MISC other than box 3, then the instructions above do not apply. If this is the case, please do not continue the discussion in this thread. Post a new separate question of your own. In your new question, clearly describe what the 1099-MISC income is for, and which box of the 1099-MISC form it is in.

Turbo Tax prompted me to put in parents taxable income for the Kiddie Tax. Is this supposed to apply to a minor with tribal per capita?

@eli.andrew - Yes, kiddie tax applies to tribal per capita payments. It applies to any income that is not from working.
