Question about what qualifies for this... - Care provided by a relative who is not your dependent or your spouse

My mother in law keeps our baby for us all day everyday while we work...does this mean we qualify for the deduction?

You can use the dependent care credit for expenses paid to any caregiver, including most relatives, but not if the caregiver is your spouse or another one of your dependents.  

To report the expense and claim the credit,  you will need the caregiver's SSN, and the IRS will be looking to that person's tax return to see if they report matching taxable income.
