If you are having to ask this question, then you really need to get professional help ASAP. An estate adminitrator is "PERSONALLY" responsible for timely filings of any tax returns that come due after the date of death. So if the person has been gone for more than one tax season, it is you who has to pay the late filing penalties out of *your* pocket. The estate is not legally or financially liable for the incorrect actions (or lack of action) of the legally recognized administrator.

I suggest that you also read IRS Pub 559 (Survivors, Executors, and Administrators) for a lot of good information about filing the final return and estate return and other requirements.
