Can I claim my 28 yr old on medical disability for a yr but wrkd 2 mths b4 it started he has filed for disability pending and will I have to pay his 1095 Ins tax credit?

If your son had over $4300 of income --- NOT counting Social Security-----then you cannot claim him as a dependent for 2021.   If he had less than $4300 of income you may be able to claim him as a qualified relative and get the $500 credit for other dependents.   You do not have to pay for his marketplace insurance or premium tax credit.   He has to file a tax return and enter that 1095A.

Yes, if he made less than $4,300 for the year and you provided more than half of his support, then you could claim his as a dependent.

 

Yes, if you claim him, you will be responsible for including his 1095-A on your return.  Depending on the income calculations, you may end up having to repay the Advanced Premium Tax Credits he received.  It is possible that claiming him will cost you more than helps you.
