Why am I not eligible for tuition and fees deduction?

The Tuition and Fees deduction had originally expired at the end of 2016 so it was no longer available in the software. More details here What is the Tuition and Fees Deduction?

But the new Bipartisan Budget Act of 2018 that was just recently signed into law a few days ago, has extended it. Now the IRS is reviewing the tax extenders to determine next steps and you can see their statement here IRS Statement on Retroactive Extender Provisions 

This could take some time before they get things updated and once they do, the TurboTax software will then be updated to reflect these changes just as soon we receive direction from IRS. The options right now would be to either wait until word is provided from the IRS or file return now and amend later.
