The benefits are tax free and don’t have to be reported. If not used for qualified education expenses there is no effect on AOC.

  1. Do I have to claim Chapter 35 benefits with my 1098-T?
  2. No. Chapter 35, Dependent Educational Assistance (DEA) is a stipend-based program only. Therefore, no tuition and fees are covered.
  3. Do you still have to enter the amount you received or simply $0 since it is a tax-free benefit?
  4. Answer No, when asked if you received VA educational benefits.

Chapter 35 funds (also known as Dependent Education Assistance / Survivor Dependent Benefits) do NOT have to be subtracted as tax free educational so they do not affect your American Opportunity Credit.  This is because they are not required to be used for educational expenses.   See Veterans’ Benefits.
