On the 1098t for my daughter, the scholarship is more than the cost of tuition. Do I have to file the 1098t at all?

Do either one of us, my daughter or my self have to use the 1098t form since it would not benefit either one of us?

In the event that scholarships exceed the cost of qualifying expenses (tuition, materials for class including books, etc.), the difference must be claimed by the student as income.  If your daughter's scholarship includes non-qualifying items such as room and board, then she must claim the difference as income and therefore will need to file the 1098-T.  Turbo Tax figures the difference between the scholarship and expenses and will put that amount on the appropriate line of her tax return.
