Claiming school expenses for incarcerated spouse

You can claim a deduction for the tuition if you receive a Form 1098-T from the College that provided the courses. Please note that to take advantage of any credits, the courses that he took must be part of a program that leads to a Degree. I have included some FAQ links below that help describe your options regarding Eduction Deductions. Please keep in mind that additionally the Hope and Lifetime learning credits are denied if:

"Denial of credit if student convicted of a felony drug offense

The Hope Scholarship Credit under subsection (a)(1) shall not be allowed for qualified tuition and related expenses for the enrollment or attendance of a student for any academic period if such student has been convicted of a Federal or State felony offense consisting of the possession or distribution of a controlled substance before the end of the taxable year with or within which such period ends."
