This is a legal question not a tax question. See a lawyer.

I agree with @Anonymous that you need to consult with an attorney.

 

Having said that, a DBA is not an entity; so a DBA can't be under an LLC. 

 

The single member LLC is the legal entity that provides the legal protection.  Discuss this with an attorney so you know the next steps, which may involve getting some insurance.
