Question

I started an LLC this year but had no income but a lot of start up cost

Hi there,

 

I started a buisness this year and had almost $7k worth of business start up cost. I still am finishing products for launch, and due to that had no income in 2025. I know I need to file my taxes. I got divorced in 2025 as well as have 3 young kids. I had no other sources of income. Would i recieve any refund for the expenses I incurred starting the business expecially since I did not have any income? I am lost and my ex is helping me navigate though he isn't entirely sure. We are unsure who would make more sense filing the kids under. This is a whole new advanture I have no idea how to navigate. Any advice would be much appreciated.

You can't deduct any of the start up expenses until the year you are in business, which usually means generating sales. So if you were not in business in 2025, you will get no benefit from them on your 2025 tax return. The children would normally be claimed by the parent they live with, but if they live with you, you can give the children's other parent permission to claim them, if they qualify otherwise. 

 

You can complete Form 8332 to give the non-custodial parent permission to claim the children. Since you have no income, it will not benefit you to claim them on your tax return.

Personally, I think you should go to a tax professional this year.

 

Between the new business, the divorce, and trying to figure out who can and should claim the kids, a good tax professional will be able to analyze the specific details of your situation and be able to give personalized advice.
