So my ex filed a petition on may 1st 2023 and I took it to court but it was three months later I had a court date they say I owe $3400 to back pay

And I’m on $10 plus my 2 kids so $180 total a week ($10) a week towards $3400 but it’s been like 22 weeks so I owe $3260 will my own refund be garnished ?! I’m in NY STATE

Either the feds or state agency can garnish your refund for back child support.

As @Bsch4477  said, the Federal government or the state government may be empowered to collect the debt.

The Federal Treasury Offset Program may collect the debt by holding back money from a Federal payment to the debtor.  Website may be viewed here.

The agency must notify you in writing of their effort to collect the debt.  See here.
