1) do not amend until the original tax return has been processed. It may make matters worse if the iRS adjusts something that you weren't expecting.
2) on the stimulus, tell me more about that. Are you stating that you received the stimulus in March - May, 2021 for this 'dependent' or are you stating that you claimed the Recovery Rebate Credit on Line 30 for Form 1040 for the 2021 tax year. Your answer makes a difference in how to proceed. Please respond. What is on Line 30 of the tax return you submitted?
Also if someone else's return is rejecting because you already claimed them, then they don't have to wait for you to amend. Even if you amend it won't release their ssn from the IRS so they will have to print and mail their return this year.
If those boys did not live with you all of 2021 (as well as met other requirements), you couldn't claim them anyway, even if she had given you permission.
She never gave me permission. I know I made an honest mistake in doing this I try to amend my taxes and they are charging me alot I can't afford this
I'm stating that I received all the stimuluses when I was not supposed to and I didn't do the recovery rebate deal. I also just received a 600.00$ payment from Department Of Revenue Oregon. And I already did my taxes in March everything was approved.
@vieraerika435 The fact that you received a refund that you were not entitled to receive and now will have a problem repaying is your own issue and you will have to deal with it. Sooner rather than later would be better. If your GF filed her own return and got the stimulus money and other child-related credits for her children, the IRS is eventually going to see that you received money you should not have received for children with the same Social Security number. Then they will want you to repay it with interest and penalties. It would be better for you to amend your return and remove the dependents that you should not have claimed. If the children are not related to you then you were not entitled to receive child tax credit, earned income credit or the recovery rebate credit for claiming them. You may have to use a payment plan to repay the money you received.

So that you understand----if you GF's children are not related to you---you are not their bio-dad----the only child - related credit you can get for claiming them is the $500 credit for other dependents and that would only be available to you if they lived with you for the whole year and they could not be claimed by anyone else including your GF. You cannot claim someone else's child to get the stimulus money, the earned income credit, child tax credit, or to file as Head of Household. If you did any of those things you made a big mistake for which you will have to repay anything you received as a result of your mistake.
@vieraerika435 what makes this more complicated than what @xmasbaby0 stated is that you are suggesting that you received the stimulus payments last spring at the tune of $1400 per "dependent". if that is true, then that means you also claimed the "dependent" on the 2020 (and maybe 2019) tax return because that is the basis on how the IRS knew to send you those payments last spring. I don't see how those stumulus checks can end up on an amendment.
How to unravel the Oregon payment of $600 is not part of the federal amendment process.
It may be best to find a local tax person to help you straighten out this mess. It is not simple to explain and unravel all the spaghetti on an anonymous board.
