How long does it take for an amending 2020 tax return? I sent in an amendment june 24th and they only refunded us $328 and not the $2200. what does that mean?

My daughter never got the third stimulus and we (the parents) didn't either.  So I amended her return and checked the box can anyone else claim you? and checked "no."  When I did her original taxes, I did not check the box on recovery rebate credit worksheet.   So a few weeks ago, my daughter received a deposit of $328 in her bank but it was supposed to be a lot larger than that. Do I send another amendment?

The refund was probably from the original tax return because amended returns are currently taking 6 months or longer to process.    If mailed in June then the mail might not even have been opened  yet since mail processing at the IRS is way behind and there is a huge backlog.

Note:

 

She cannot claim herself if you *can* claim yer even if you do not claim her - the tax law does not permit that.

 

In fact there are special questions just for that in the personal information section: 1) CAN you be claimed as a dependent by another taxpayer?; and 2) Were (or will you be) claimed by that taxpayer?

 

If #1 is yes then the student cannot claim them self.

If #1 is yes and #2 is no, then the child still cannot claim them self but there are certain educational credits normally claimed by the parent that the student can claim. That is the only difference.

We did not claim her for 2020.  She is 22 and lives at college all year.

You can claim a full time student  not older than  23.   Being away from home is a temporary absence and counts as time lived with you if your home would be her home if not attending school.

 

Here are the rules:

---Tests To Be a Qualifying Child---
(Must pass ALL of these tests)

NOTE: If a child passes all of these tests he must say “yes” on his/her own tax return (if he/she files one) that another taxpayer CAN claim him/her as a dependent even if they DO NOT claim him/her)

1. The child must be your son, daughter, stepchild, foster child, brother, sister, half brother, half sister, stepbrother,stepsister, or a descendant of any of them.

2. The child must be (a) under age 19 at the end of 2020, (b) under age 24 at the end of 2020 and a full-time student* for any part of 5 months of 2020, or (c) any age if permanently and totally disabled and must be younger than you (or your spouse if filing jointly).

3. The child must have lived with you for more than half of the year (There are exceptions for temporary absences such as school, illness, business, vacation, military service).

4. The child must not have provided more than half of his or her own support for the year.

5. If the child meets the rules to be a qualifying child of more than one person, you must be the person entitled to claim the child as a qualifying child.

6. The child is not filing a joint return.

7. The child must be a U.S. citizen, U.S. resident alien, U.S. national, or a resident of Canada or Mexico

*A full-time student is a student who is enrolled for the number of hours or courses the school considers to be full-time attendance during some part of each of any 5 calendar months of the year.
